REDWOOD CREEK® GREATER OUTDOORS PROJECT TERMS AND CONDITIONS
NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO APPLY FOR THE REDWOOD CREEK WINES GREATER OUTDOORS PROJECT GRANT.
1. ELIGIBILITY: APPLICANTS MUST BE LEGAL RESIDENTS OF ONE OF THE FIFTY (50) UNITED STATES OR THE DISTRICT OF COLUMBIA AND AT LEAST 21 YEARS OLD AT THE TIME OF APPLICATION. An applicant must only enter on behalf of and as representative of his/her organization that is currently registered as a 501(c) (3) Environmentally Focused Non-Profit organization and is domiciled and resides within the United States. 501 (c) (3) Environmentally Focused Non-Profit organizations must contain individuals that are at least 21 years of age and make up at least 70% of the membership. Any 501 (c) (3) Environmentally Focused Non-Profit organizations that does not qualify on membership or whose project is not targeted to benefit at least 70% individuals that are 21 years of age or older will not be eligible. Determination of whether an organization qualifies as an environmentally focused non-profit shall be under the supervision of Hunter Public Relations ("Administrator") whose decisions shall be final in all matters relating to the Greater Outdoors Project. Employees of the Administrator, Redwood Creek, ("Sponsor"), or their alcoholic beverage distributors and retailers, affiliates, subsidiaries, advertising and promotion fulfillment and/or the immediate family members of each are not eligible to participate. No Applicant may apply is his/her organization holds an alcohol license or permit. The Greater Outdoors Project is subject to all applicable federal, state and local laws and regulations. Void for Applicants and non-profit organizations that reside in UT, TN, Puerto Rico, U. S. Virgin Islands and other U. S. territories and possessions, military installations and commonwealths where prohibited by law.
2. SPONSOR: Redwood Creek, dba Frei Bros. Winery, Healdsburg, CA. 95448
3. TO APPLY: The Grand Application Process begins at 12:00:01 AM Eastern Time ("ET") on March 1, 2008 and ends at 11:59:59 PM Eastern Daylight Savings Time ("EDT") on May 15, 2008. To apply, visit www.RedwoodCreek.com, complete the required information on the Official Application Form displayed, and submit the Online Application Form as directed. Individuals who submit an Application will be deemed the "Applicant" applying for a Grant on behalf of their non-profit organization. Applicants will be required to provide the following: A) Submit your complete name, address, telephone number, date of birth, E-mail address, and the name, address and telephone number of the Non Profit Organization on whose behalf you are applying (c); B) Submit a Project Plan of no more than 750 words which will preserve, protect and/or provide access to the Great American Outdoors. The Project Plan must benefit the American public (at least 70% of which are 21 years of age or older); C) Submit a budget for the Project Plan not to exceed $50,000; and D) Submit up to two (2) digital photos that demonstrate the efforts conducted by the organization and/or members. (A, B, C and D stated herein are collectively, "Application"). The digital photographs must be in JPEG or PDF format and cannot exceed 300 dpi (dots per inch) or 1 MB (megabit). Limit one Application per Non Profit organization. In the event the same Application is submitted more than once, the first Application received will be eligible and all duplicate Applications will be disqualified. All Applications become the property of the Sponsor. All Applications will not be acknowledged or returned. Sponsor is not responsible for lost, late, incomplete, misaddressed, or otherwise misdirected Applications that are processed late or incorrectly or are lost due to computer or electronic malfunction or other error. By submitting an Application, including photographs, Applicants have irrevocably granted Sponsor the royalty-free right throughout the world to use, re-use, copy, publish, republish in whole or in part, edit, add to, modify, and rearrange the Application in whatever media, including without limitation edit, rearrange, and/or copy the Application for use in the advertising and promotion of Sponsor products without further permission, consideration or payment to the Applicant, except where prohibited. IF YOU WOULD LIKE YOUR E-MAIL ADDRESS USED FOR FUTURE MARKETING PURPOSES, PLEASE MAKE SURE THE APPROPRIATE BOX ON THE APPLICATION FORM IS CHECKED.ALL ONLINE APPLICATIONS MUST BE RECEIVED BY 11:59:59 PM EDT, ON MAY 15, 2008.
4. JUDGING CRITERIA: All Applications will be judged by Sponsor, whose decisions in all matters relating to the Greater Outdoors Project will be final and binding. Applications will be reviewed and five (5) Finalist Applications will be selected based on the following criteria: Persuasiveness of the Application (0-20 points); Does the Application help preserve, protect or provide access to the Great American Outdoors (0-20 points); Feasibility of Application (0-15 points); Feasibility of Proposed Budget (0-20 points); and Overall impression of the Application (0-25 points). The five (5) Finalist Applicants will be notified by telephone, email, or mail on or about May 30, 2008. Each Finalist Applicant will receive an Affidavit of Eligibility and Liability and a Publicity Release. Each Finalist Applicant will be required to complete, sign and return the Affidavit of Eligibility and Liability and Publicity Release within ten (10) business days of delivery. Non compliance within this time period may result in disqualification and the selection of an alternate Finalist Application. Any Finalist Applicant notification returned to Sponsor as undeliverable may result in disqualification and the selection of an alternate Finalist Applicant. In the event that more than one Application is received with the same or nearly identical submission, only the first such Application received will be eligible. In the event of a tie, the Applicant among the tied Applications with the highest score in the Overall Impression of the Application Judging Criteria will be the Finalist. The number of Grants to be distributed and amount of Grant awards will be determined by Sponsor within its sole and absolute discretion based on the nature and quality of the Applications submitted. Sponsor reserves the right not to select any Finalists or award any Grants, if in their sole and absolute discretion they do not receive a sufficient number of qualified Applications. If your Applications is selected, you will be required to execute a Grant Award Agreement which will detail the terms and conditions of the Grant.
5. ONLINE VOTING: The five (5) Finalist Applications will be posted at
www.redwoodcreek.com between 12:01 AM EDT on June 15, 2008 and 11:59:59 PM EDT on July 31, 2008. Individuals who log on to
www.redwoodcreek.com between 12:01 AM EDT on June 15, 2008 and 11:59:59 PM EDT on July 31, 2008 will be asked to select one (1) Finalist Application (hereinafter, "Online Voting Period")*. Limit one (1) vote per person/email address per day. You may also vote by Wireless Entry by text messaging between 12:01 AM EDT on June 15, 2008 and 11:59:59 PM EDT on July 31, 2008. To vote via Text Messaging, submit an SMS or text one of the five (5) voting codes that corresponds to the Finalist Entry posted at www.redwoodcreek.com from your wireless phone to 39668. The Finalist Application who receives the highest number of votes will be deemed The Greater Outdoors Project Grand Grant Recipient. The Finalist Application that receives the second highest number of votes will be deemed The Greater Outdoors Project Runner-Up Grant Recipient. In the event of a tie among the number of highest number votes or second highest number votes, the Sponsor will determine the Grand Grant Recipient or the Runner-Up Grant Recipient based on the judging criteria stated in Paragraph #4. Individuals who vote for a Finalist via SMS or Text Messaging will be charged standard carrier-specific text message or call rates depending upon the individual's wireless or non-mobile pricing plans for each vote you make on your cellular phone bill by your cellular provider. Other carrier-specific rates may also apply, depending on your individual wireless pricing plan, in accordance with your wireless customer agreement. You are responsible for all applicable taxes associated with placing a SMS or text message vote. Sponsor in its sole discretion may add or delete a wireless carrier at any time, without notice.
6. ONE (1) GRAND GRANT: One (1) $50,000 check made payable to the Non Profit Organization listed on the winning Finalist Application plus the opportunity to be featured in a national print magazine advertisement campaign (up to three magazines) created by illustrator Jeff Foster. Total value of the Grand Grant: $50,000. The selection of magazines which feature the national print magazine advertisement will be designated by Sponsor. In the event, for whatever reason, the Sponsor does not create and/or implement the national print magazine advertisement campaign, no additional compensation will be paid to the Non Profit Organization. No substitution, assignment, or transfer of any Grant permitted. If selected as a Greater Outdoors Project Grand Grant Recipient, Applicant must be available to participate in any and all scheduled public relations activities on dates designated by Sponsor. In the event Applicant is not available on dates designated by Sponsor the Applicant may be disqualified and the Greater Outdoors Project Grand Grant may be awarded to an alternate Applicant.
7. ONE (1) RUNNER-UP GRANT: One (1) $10,000 check made payable to the Non Profit Organization listed on the Runner-Up Finalist Application. Total value of the Grant: $10,000.
8. CLAIMING PRIZES/RELEASES: Eligibility, age and grant claim by Applicants on behalf of the Grand Grant Non Profit Organization recipient and Runner-Up Grant Non Profit Organization recipient are subject to verification. The Grand Grant Non Profit Organization and the Runner-Up Grant Non Profit Organization will be notified by overnight mail delivery on or about July 25, 2007. Sponsor and Promotional Partner are not responsible for fraudulent calls or E-mails made to entrants not by Sponsor or Promotional Partner. Potential Grand Grant Non Profit Organization and Potential Runner-Up Grant Non Profit Organization must sign before a notary and return an Affidavit of Eligibility/Prize Acceptance/Liability and (where legally permissible) a Publicity Release Form within ten (10) business days of receipt. Non-compliance may result in disqualification and the Grant may be awarded to an alternate Non Profit Organization based on the judging criteria outlined in Paragraph #4. Should a Non Profit Organization be awarded a Grant, the organization will not receive any grant money until a Grant Agreement Letter, a Release of Liability and Publicity Consent supplied by the Promotional Partner has been signed by the Non Profit Organization, and the 501(c)(3) Non-Profit documentation has been received by the Promotional Partner. The Grant Agreement letter will bind the Non Profit Organization to the Terms and Conditions as set forth in the Grant Agreement letter. The Publicity Consent form will authorize the Sponsor and Promotional Partner to use the Non Profit Organization's likeness, name, biography and essay for purposes of advertising and trade.
9. INTERNET/WIRELESS: If for any reason the Greater Outdoors Project is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor or Promotional Partner which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Greater Outdoors Project, the Sponsor or Promotional Partner reserve the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Greater Outdoors Project. The Sponsor and Promotional Partner assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Applications. The Sponsor and Promotional Partner are not responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsor due to technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in this Contest or downloading any materials in the Greater Outdoors Project. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GREATER OUTDOORS PROJECT IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity or eligibility of any entry based on an e-mail address, the entry will be declared made by the "Authorized Account Holder" of the e-mail address submitted at time of Application. "Authorized Account Holder" is defined as the natural person, 21 years of age or older, who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, education institution, etc.) that is responsible for assigning e-mail addresses or wireless phone numbers for the domain or number associated with the submitted e-mail address or wireless phone carrier. Use of automated devices are not valid for Application.
10. GENERAL: In regard to the Grand Grant and the Runner-Up Grant, no substitution, assignment, or transfer of any prize permitted except that Sponsor reserves the right to substitute a prize of equal or greater value in the event that an offered prize is unavailable. Total retail value of all Grants to be awarded: $60,000. By entering this Grant Process and/or accepting a prize, applications and Grand Grant Non Profit Organization and Runner-Up Grant Non Profit Organization: (1) agree to be bound by these Terms and Conditions; (2) agree to release Sponsor, Promotional Partner its alcoholic beverage distributors and retailers; affiliates, subsidiaries; advertising and promotion fulfillment and/or judging agencies and all related entities from all liability, claims, action, or proceedings relating to the Greater Outdoors Project and from injuries or damages relating to acceptance or use of the Grants; and (3) agree to share customer information contained in their entry with the Sponsor, or Promotional Partner; and (4) consent to the use of their names, voices, pictures, likenesses, entries, and recipes for editorial, publicity, advertising and promotional purposes in any medium throughout the world in perpetuity without additional compensation unless prohibited by law.
11. GRANT RECIPIENTS LIST/TERMS AND CONDITIONS: To receive the names of the Grand Grant Non Profit Organization and the Runner-Up Grant Non Profit Organization, (available after August 1, 2008), or a copy of the Terms and Conditions, send a self-addressed, stamped #10 envelope to: "Greater Outdoors Project", c/o Hunter Public Relations, 41 Madison Avenue, 5th FL, New York, NY 10010. Please specify "Terms and Conditions" or "Grant Recipient List" on the outer mailing envelope. Your request must be sent so that it is received by December 31, 2008.
*The Terms and Conditions for the Redwood Creek Greater Outdoors Project have been amended as of July 16, 2008. The Online Voting Period of the Redwood Creek Greater Outdoors Project will start at 12:01 AM EDT on July 17, 2008 and will end at 11:59 PM EDT on July 31, 2008. All Online Votes received between 12:01 AM EDT on June 15, 2008 and 11:59 PM EDT on July 16, 2008 will not be counted and will not be eligible in the Online Voting Period.
